When purchasing real property, it is essential to engage an advisor who solely represents your interests – an advisor experienced in real estate transactions and familiar with potential pitfalls, processes, and procedures.

PrivatRevision’s team of advisors can provide the standard buyer advisory services typically offered by attorneys or real estate agents. Additionally, we can assist with related matters such as tax implications, financing, and other considerations.

PrivatRevision offers buyer advisory services at a fixed price of DKK 7,500 including VAT*. This includes a thorough review of the purchase agreement and all related transaction documents. For single-family houses and summerhouses, these documents often pertain to land conditions, plot size, boundaries, local regulations, public property data, taxes and, crucially, the condition report, electrical report, and the seller’s duty to disclose information loyally.

The process is as follows:

  1. When entering into a purchase agreement – typically through a real estate agent – you should ensure that an advisor’s approval clause is included. This is often found in section 11 of the purchase agreement and may, for example, state: “The transaction is subject to the approval of the buyer’s advisor regarding the transaction in its entirety. Any objections must be communicated to the buyer’s real estate agent no later than six business days after all parties have signed the purchase agreement.”
  2. The buyer advisory process then begins with an initial discussion and agreement, if not already conducted prior to signing the purchase agreement.
  3. Once the purchase agreement is signed, the real estate agent provides a range of information to the buyer’s advisor.
  4. We then review the transaction documents and raise any questions with you and the real estate agent. Based on this review, we prepare a buyer advisory memorandum, which informs you in writing of any reservations that should be communicated to the real estate agent and other considerations you should take into account.
  5. This typically results in a clarification of the recommended reservations.
  6. Once agreement is reached on the reservations, we send a conditional approval letter to the real estate agent, typically stating that the transaction is approved subject to conditions 1, 2, and 3.
  7. When these conditions are met – or if the buyer chooses to waive them – the transaction is finalized, provided the financial institution has not rejected the financing. Alongside the advisor’s approval clause, there is generally also a reservation for the buyer’s financial institution’s approval of the transaction with respect to financing.

Once the transaction is finalized, a title deed must be prepared, and post-completion matters must be completed. Post-completion matters include ensuring that the seller’s encumbrances are released and that the purchase price is disbursed in a timely manner, among other tasks. Deed preparation and post-completion matters constitute a separate service.

*For properties with a purchase price exceeding DKK 8 million, a price/risk surcharge will be applied.

**Deed preparation and post-completion matters are relevant when the purchase agreement stipulates that the buyer is responsible for preparing the deed. This is generally the case east of the Great Belt (Storebælt). For property transactions west of the Great Belt, it is typically the seller’s responsibility to arrange for the deed to be prepared for the buyer.
